Terms and conditions

Introduction

These are our General Terms and Conditions. These General Terms and Conditions always apply when you use our Website or place an order through our Website, and they contain important information for you as a buyer. Please read them carefully. We also recommend that you save or print these General Terms and Conditions so that you can consult them at a later time.

Article 1. Definitions
1.1. Dog Training Dick Staal: based in Nunspeet and registered with the Chamber of Commerce under file number 66366089, trading as Dog Training Dick Staal.
1.2. Website: the Website of Dog Training Dick Staal, to be found on www.dogtrainingdickstaal.com and all of its subdomains.
1.3. Customer: the natural person or corporation who enters into an agreement with Dog Training Dick Staal and/or is registered on the Website.
1.4. Agreement: any arrangement or agreement between Dog Training Dick Staal and Customer of which the General Terms and Conditions are an integral part.
1.5. General Terms and Conditions: these General Terms and Conditions.

Article 2. Applicability of the General Terms and Conditions

2.1. The General Terms and Conditions apply to all offers, agreements and deliveries of Dog Training Dick Staal, unless explicitly agreed otherwise in writing.

2.2. If Customer in his order, confirmation or any other communication alleging acceptance of the General Terms and Provisions includes any provisions that differ from, or are not included in the General Terms and Conditions, such provisions will only be binding upon Dog Training Dick Staal if and in so far as Dog Training Dick Staal has accepted them in writing.

2.3. In cases where specific product or service-related terms and conditions apply in addition to these general terms and conditions, Customer can always invoke the applicable condition that is most favorable to him in the event of incompatible general terms and conditions.

Article 3. Prices and information

3.1. All prices posted on the Website and in other materials originating from Dog Training Dick Staal include taxes and other levies imposed by the government, unless stated otherwise on the website.
If shipping costs are charged, these will be clearly stated in good time before the contract is concluded. These costs will also be displayed separately in the ordering process.

3.2. The content of the Website is composed with the greatest care. Dog Training Dick Staal cannot, however, guarantee that all information on the Website is correct and complete at all times. All prices and other information posted on the Website and in other materials originating from Dog Training Dick Staal are subject to obvious programming and typing errors.

3.3. Dog Training Dick Staal cannot be held responsible for deviations in colour that result from the quality of the colours displayed on the screen.

Article 4. Conclusion of the Agreement

4.1. The Agreement will be deemed to be concluded at the moment Customer accepts the offer of Dog Training Dick Staal subject to the conditions laid down by Dog Training Dick Staal.

4.2. If Customer has accepted the offer by electronic means, Dog Training Dick Staal will confirm receipt of acceptance of the offer by electronic means without delay. Until such receipt of acceptance is confirmed, Customer will have the possibility to terminate the Agreement.

4.3. If it is found that, in accepting or otherwise entering into the Agreement, Customerhas provided incorrect data, Dog Training Dick Staal will have the right to postpone the Agreement until the correct data is received.

Article 5. Registration

5.1. To make optimal use of the Website, Consumer can register using the registration form/the account sign-in option on the Website.

5.2. During the registration process, Consumer will be asked to choose a user name and password with which he can log on to the Website. Consumer alone is responsible for choosing a sufficiently reliable password.

5.3. Consumer must keep its login credentials, user name and password strictly confidential. Dog Training Dick Staal cannot be held liable for any misuse of the login credentials and is always entitled to assume that Consumer who logs on to the Website is the party that it professes to be. Consumer is responsible for and bears the full risk of any and all actions and transactions performed via Consumer’s account.

5.4. If Consumer knows or has reason to suspect that its login details have become available to unauthorised parties, it will be required to change its password as soon as possible and/or to notify Dog Training Dick Staal accordingly so as to allow Dog Training Dick Staal to take appropriate measures.

Article 6. Execution of the Agreement

6.1. As soon as Dog Training Dick Staal has received the order, it will send the products to Consumer without delay and with due regard for the provisions of paragraph 3 of this article.

6.2. Dog Training Dick Staal is authorised to engage third parties in the fulfilment of its obligations under the Agreement.

6.3. Well ahead of the date on which the Agreement is signed, information will be posted on the Website which clearly describes the manner in which and the term within which the products will be delivered. If no delivery term has been agreed or stated, the products will be delivered within 30 days at the latest.

6.4. If Dog Training Dick Staal is unable to deliver the products within the agreed term, it will notify Consumer accordingly. In that case Consumer can decide either to agree to a new delivery

date or to terminate the Agreement without incurring any costs.

6.5. Dog Training Dick Staal advises Consumer to inspect the products upon delivery and to report any defects within an appropriate period, preferably in writing or by email. For further details, see the article about guarantee and conformity.

6.6. The risks associated with the products will transfer to Consumer as soon as the products are delivered at the agreed delivery address.

6.7. If the ordered product can no longer be supplied, Dog Training Dick Staal is entitled to deliver a product which is comparable in nature and quality to the ordered product. In that case, Consumer will have the right to terminate the Agreement without incurring any costs and to return the product free of charge.

Article 7. Subscription policy

7.1 We offer the option to subscribe to our complete online program through the Dick Staal Online Training School. When subscribing to a plan, the customer chooses a period of one month, quarter or year.

7.2 All subscriptions are ongoing and will only stop if cancelled. Cancellation can be done via email to info@dogtrainingdickstaal.com and will be confirmed via email. If a subscription is not cancelled, it will be automatically renewed on a monthly, quarterly, or yearly basis, depending on the subscription type the customer has chosen.

7.3 The first payment is made with the payment method chosen by the customer, and the customer agrees to our general terms and conditions and authorizes us to debit the following subscription payments. These will be debited on a monthly, quarterly, or yearly basis, depending on the subscription type the customer has chosen.

7.4 If the customer cancels before the next payment term date is reached, no further charges will be incurred.

7.5 It is not allowed to chargeback payments, as this is against the terms and conditions of this agreement, and the subscription will be debited again.

Article 8. Return policy for online services and online courses

8.1 Subscriptions to online services and online courses cannot be returned. However, we offer a 14-day "money-back guarantee". The customer is eligible for a refund if the content significantly deviates from their expectations or if the account does not work.

8.2 The customer is not eligible if they have already viewed more than 25% of a particular course with the account, as they have consumed a significant amount of content in a short time and are therefore unlikely to be dissatisfied with the content.

Article 9. Right of withdrawal/return

9.1. This article only applies if Consumer is a natural person who is not acting in his or her professional or commercial capacity. Business Consumers therefore have no right of withdrawal.

9.2. Consumer will have the right to dissolve the distance Agreement with Dog Training Dick Staal within 14 days after receiving the product, free of charge and without stating reasons.

9.3. The term commences on the day after the product was received by the consumer, or a third party designated by the consumer, who is not the transporting party, or:

if the delivery of a product involves different deliveries or parts: the day on which Consumer, or a third party designated by Consumer, received the last delivery or the last part;
with contracts for the regular delivery of products during a given period: the day on which Consumer, or a third party designated by Consumer, received the last product;

if Consumer has ordered several products: the day on which Consumer, or a third party designated by Consumer, received the last product.

9.4. Only the direct costs incurred for the return shipment are for Consumer’s account. This means that Consumer will have to pay the costs of returning the product. Any shipping costs paid by Consumer and the purchase price paid for the product will be refunded to Consumer if the entire order is returned.
9.5. During the withdrawal period referred to in paragraph 1, Consumer will treat the product and its packaging with the utmost care. Consumer may not open the packaging or use the product unless this is necessary in order to determine the nature of the products, their features and their operation.

9.6. Consumer is only liable for the product’s devaluation that is a consequence of his handling the product other than as permitted.

9.7. Consumer can terminate the Agreement in accordance with paragraph 1 of this article by reporting the withdrawal (digital or in other form) to Dog Training Dick Staal, within the withdrawal period, by means of the model form for right of withdrawal or in some other unequivocal way. If Dog Training Dick Staal makes it possible for Consumer to declare his withdrawal via electronic/digital means, then after receiving such a declaration, Dog Training Dick Staal sends immediate confirmation of receipt.

9.8. As quickly as possible, but no later than 14 days after the day of reporting as referred to in paragraph 1, Consumer shall return the product, or hand it over to (a representative of) Dog Training Dick Staal. Consumer can send the product directly to Dog Training Dick Staal without a notice of withdrawal in advance within the period as mentioned in paragraph 1. Consumer must, in this case, include a written notice of withdrawal, such as the model form.

9.9. Any amounts already paid by Consumer (in advance) will be refunded to Consumer as soon as possible, and in any case within 14 days after dissolution of the Agreement. If Consumer chose an expensive method of delivery in preference to the cheapest standard delivery, Dog Training Dick Staal does not have to refund the additional costs of the more expensive method. Except in cases in which Dog Training Dick Staal has offered to retrieve the product himself, he can

postpone refunding until he has received the product or until Consumer proves he has returned the product, depending on which occurs earlier.

9.10. Information about the applicability or non-applicability of a right of withdrawal and any required procedure will be posted clearly on the Website, well before the Agreement is concluded.

9.11. The right of withdrawal does not apply to:

The delivery of digital content other than on a material medium, but only if the delivery commenced with Consumer explicit prior agreement, and Consumer declared that this implied his having lost his right of withdrawal;

Article 10. Payment

10.1. Customer shall pay the amounts due to Dog Training Dick Staal in accordance with the ordering procedure and any payment methods indicated on the Website. Dog Training Dick Staal is free to offer any payment method of its choice and may change these methods at any time. In cases of payment after delivery Customer will be given a term of payment of 14 days entering on the day after delivery.

Article 11. Warranty and conformity

11.1. This article only applies if Consumer is a natural person who is not acting in his or her professional or commercial capacity. If Dog Training Dick Staal gives a separate warranty on the products then, without prejudice to the aforesaid, this applies to all types of Consumers.

11.2. Dog Training Dick Staal guarantees that the products are in conformity with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and with the existing statutory provisions and/or government regulations that are in force from the date of entering into the Agreement. If specifically agreed, Dog Training Dick Staal also guarantees that the product is suitable for other than normal use.

11.3. If the delivered product is not in conformity with the Agreement, Consumer must inform Dog Training Dick Staal within a reasonable period of time after he has discovered the defect.

11.4. If Dog Training Dick Staal deems the complaint to be correct, the faulty product(s) will be repaired, replaced or refunded in consultation with Consumer. The maximum amount of compensation is, having regard to the Article on liability, equal to the price paid by Consumer for the product.

Artikel 12. Warranty on business purchases

12.1. Dog Training Dick Staal guarantees that the products are in conformity with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and with the existing statutory provisions and/or government regulations that are in force from the date of entering into the Agreement. If specifically agreed, Dog Training Dick Staal also guarantees that the product is suitable for other than normal use. Otherwise, it applies that the product is suitable for normal use.

12.2. If the delivered product is not in conformity with the Agreement, Customer must inform Dog Training Dick Staal within a reasonable period of time after he has discovered the defect.

12.3. If Dog Training Dick Staal deems the complaint to be correct, the faulty product(s) will be repaired, replaced or (partially) refunded in consultation with the Customer.

Article 13. Complaints handling procedure

13.1. If Customer has any grievances in connection with a product (in accordance with the article on warranties and conformity) and/or about other aspects of Dog Training Dick Staal’s service, it can submit a complaint by telephone, by email or by post. See the contact details at the bottom of the General Terms and Conditions.

13.2. Dog Training Dick Staal will respond to the complaint as soon as possible, and in any case within 1 days after having received it. If it is not yet possible for Dog Training Dick Staal to formulate a substantive reaction to the complaint by that time, Dog Training Dick Staal will confirm receipt of the complaint within 1 days after having received it and give an indication of the term within which it expects to be able to give a substantive or definitive reaction to Customer's complaint.

13.3. If Customer is a natural person who is not acting in his or her professional or commercial capacity, it can file a complaint through the European Online Dispute Resolution platform, available at: http://ec.europa.eu/odr/.

Article 14. Liability

14.1. This Article only applies if Consumer is a natural person or a legal entity who is acting in a professional or commercial capacity.

14.2. The total liability of Dog Training Dick Staal in respect of Consumer due to an attributable failure to perform the Agreement is limited to compensation not exceeding the price stipulated for that particular Agreement (including VAT).

14.3. The liability of Dog Training Dick Staal in respect of Consumer for indirect damage or loss, which in any case includes – but is explicitly not limited to – consequential damage, lost profit, lost savings, loss of data and damage due to business interruption, is excluded.

14.4. Aside from the cases referred to in the two previous paragraphs of this Article, Dog Training Dick Staal is not subject to any liability at all in respect of Consumer for damages, irrespective of the ground on which the action for damages is based. The restrictions set out in this Article, will, however, cease to apply if and insofar as the damage or loss is the result of an intentional act or gross negligence on the part of Dog Training Dick Staal.

14.5. Dog Training Dick Staal will only be liable to Consumer on account of an attributable failure in the performance of an agreement if Consumer issues a proper notice of default to Dog Training Dick Staal without delay stipulating a reasonable period of time in which to remedy the failure, and Dog Training Dick Staal also continues to fail to perform its obligations after that period. The notice of default must contain a description of the failure in as much detail as possible to enable Dog Training Dick Staal to provide an adequate response.

14.6. Any event giving right to compensation is always subject to the condition that Consumer

reports the damage or loss in writing to Dog Training Dick Staal as soon as possible, but no later than within 30 days after the damage or loss has arisen.

14.7. In the event of force majeure Dog Training Dick Staal is not liable to pay compensation for any damage or loss Consumer has incurred as a result.

Article 15. Personal details

15.1. Dog Training Dick Staal will process the Consumer’s personal details in accordance with the privacy statement, which can be found at https://community.dogtrainingdickstaal.com/about/policies/privacy-policy.

Article 16. Final provisions

16.1. This agreement is governed by the laws of the country of establisment of the webshop.

16.2. Insofar as not dictated otherwise by mandatory law, any disputes ensuing from the Agreement will be submitted to the competent Dutch court in the district where Dog Training Dick Staal has its registered office.

16.3. If any provision set out in these General Terms and Conditions should prove to be void, this will not affect the validity of the General Terms and Conditions as a whole. In that case, the Parties will lay down one or more new provisions in replacement which will reflect the original provision as much as is possible under the law.

16.4. The term ‘written’ in these General Terms and Conditions also refers to communication by email and fax, provided that the sender’s identity and the integrity of the email message have been sufficiently established.

Algemene voorwaarden

Inleiding

Dit zijn onze Algemene Voorwaarden. Deze Algemene Voorwaarden zijn altijd van toepassing wanneer u onze website gebruikt of een bestelling plaatst via onze website en bevatten belangrijke informatie voor u als koper. Lees ze zorgvuldig door. We raden u ook aan om deze Algemene Voorwaarden op te slaan of af te drukken, zodat u ze op een later moment kunt raadplegen.

Artikel 1. Definities
1.1. Dog Training Dick Staal: gevestigd in Nunspeet en geregistreerd bij de Kamer van Koophandel onder dossiernummer 66366089, handelend als Dog Training Dick Staal V.O.F..

1.2. Website: de website van Dog Training Dick Staal, te vinden op www.dogtrainingdickstaal.com en www.hondentrainingdickstaal.nl en al haar subdomeinen.

1.3. Klant: de natuurlijke persoon of rechtspersoon die een overeenkomst aangaat met Dog Training Dick Staal en/of zich registreert op de Website.

1.4. Overeenkomst: elke regeling of overeenkomst tussen Dog Training Dick Staal en Klant, waarvan de Algemene Voorwaarden een integraal onderdeel zijn.

1.5. Algemene Voorwaarden: deze Algemene Voorwaarden.

Artikel 2. Toepasselijkheid van de Algemene Voorwaarden

2.1. De Algemene Voorwaarden zijn van toepassing op alle aanbiedingen, overeenkomsten en leveringen van Dog Training Dick Staal, tenzij uitdrukkelijk schriftelijk anders is overeengekomen.

2.2. Indien Klant in zijn bestelling, bevestiging of enige andere communicatie waarin hij de Algemene Voorwaarden aanvaardt, bepalingen opneemt die afwijken van of niet zijn opgenomen in de Algemene Voorwaarden, zijn deze bepalingen slechts bindend voor Dog Training Dick Staal indien en voor zover Dog Training Dick Staal deze schriftelijk heeft aanvaard.

2.3. In gevallen waarin naast deze algemene voorwaarden specifieke product- of dienst gerelateerde voorwaarden van toepassing zijn, kan Klant in geval van strijdige algemene voorwaarden altijd een beroep doen op de toepasselijke bepaling die het meest gunstig is voor hem.

Artikel 3. Prijzen en informatie

3.1. Alle prijzen vermeld op de Website en in ander materiaal afkomstig van Dog Training Dick Staal zijn inclusief belastingen en andere door de overheid opgelegde heffingen, tenzij anders vermeld op de website. Een aanvulling hierop is dat de prijzen op de domeinen dogtrainingdickstaal.com exclusief belastingen vermeld staan. Dit omdat deze prijzen ook

worden aangeboden aan klanten buiten de EU. De eventuele belastingen worden bij het afrekenen berekend.
Indien verzendkosten in rekening worden gebracht, worden deze duidelijk vermeld ruim voordat de overeenkomst wordt gesloten. Deze kosten worden ook apart weergegeven in het bestelproces.

3.2. De inhoud van de Website is met de grootste zorg samengesteld. Dog Training Dick Staal kan echter niet garanderen dat alle informatie op de Website te allen tijde juist en volledig is. Alle prijzen en overige informatie vermeld op de Website en in ander materiaal afkomstig van Dog Training Dick Staal zijn onderhevig aan voor de hand liggende programmeer- en typefouten.

3.3. Dog Training Dick Staal kan niet verantwoordelijk worden gehouden voor afwijkingen in kleur die het gevolg zijn van de kwaliteit van de kleuren die op het scherm worden weergegeven.

Artikel 4. Totstandkoming van de Overeenkomst

4.1. De Overeenkomst wordt geacht te zijn gesloten op het moment dat de Klant het aanbod van Dog Training Dick Staal accepteert onder de voorwaarden die door Dog Training Dick Staal zijn vastgelegd.

4.2. Als de Klant het aanbod langs elektronische weg heeft geaccepteerd, zal Dog Training Dick Staal onverwijld de ontvangst van de aanvaarding van het aanbod langs elektronische weg bevestigen. Totdat de ontvangst van deze aanvaarding is bevestigd, heeft de Klant de mogelijkheid om de Overeenkomst te beëindigen.

4.3. Als blijkt dat de Klant bij het accepteren of anderszins aangaan van de Overeenkomst onjuiste gegevens heeft verstrekt, heeft Dog Training Dick Staal het recht om de Overeenkomst op te schorten totdat de juiste gegevens zijn ontvangen.

Artikel 5. Registratie

5.1. Om optimaal gebruik te maken van de Website, kan de Consument zich registreren met behulp van het registratieformulier/de account aanmeldoptie op de Website.

5.2. Tijdens het registratieproces wordt de Consument gevraagd om een gebruikersnaam en wachtwoord te kiezen waarmee hij op de Website kan inloggen. De Consument is zelf verantwoordelijk voor het kiezen van een voldoende betrouwbaar wachtwoord.

5.3. De Consument moet zijn inloggegevens, gebruikersnaam en wachtwoord strikt geheim houden. Dog Training Dick Staal kan niet aansprakelijk worden gesteld voor misbruik van de inloggegevens en mag er altijd van uitgaan dat de Consument die zich aanmeldt op de Website de partij is die hij beweert te zijn. De Consument is verantwoordelijk voor en draagt het volledige risico van alle handelingen en transacties die via het account van de Consument worden uitgevoerd.

5.4. Als de Consument weet of reden heeft om te vermoeden dat zijn inloggegevens bij onbevoegden bekend zijn geworden, dient hij zo snel mogelijk zijn wachtwoord te wijzigen en/of Dog Training Dick Staal hiervan op de hoogte te stellen, zodat Dog Training Dick Staal passende maatregelen kan nemen.

Artikel 6. Uitvoering van de Overeenkomst

6.1. Zodra Dog Training Dick Staal de bestelling heeft ontvangen, zal het de producten zonder vertraging naar de Consument sturen met inachtneming van de bepalingen van lid 3 van dit artikel.

6.2. Dog Training Dick Staal is gemachtigd om derden in te schakelen bij de uitvoering van haar verplichtingen uit hoofde van de Overeenkomst.

6.3. Ruim voordat de Overeenkomst wordt ondertekend, wordt er informatie op de Website geplaatst die duidelijk beschrijft op welke wijze en binnen welke termijn de producten zullen worden geleverd. Indien geen leveringstermijn is overeengekomen of vermeld, zullen de producten uiterlijk binnen 30 dagen worden geleverd.

6.4. Als Dog Training Dick Staal de producten niet binnen de afgesproken termijn kan leveren, zal het de Consument hiervan op de hoogte stellen. In dat geval kan de Consument besluiten om akkoord te gaan met een nieuwe leveringsdatum of de Overeenkomst zonder kosten te beëindigen.

6.5. Dog Training Dick Staal adviseert de Consument om de producten bij levering te inspecteren en eventuele gebreken binnen een passende termijn te melden, bij voorkeur schriftelijk of per e- mail. Zie voor meer informatie het artikel over garantie en conformiteit.

6.6. De risico's verbonden aan de producten gaan over op de Consument zodra de producten op het overeengekomen afleveradres zijn geleverd.

6.7. Als het bestelde product niet langer geleverd kan worden, heeft Dog Training Dick Staal het recht om een product te leveren dat qua aard en kwaliteit vergelijkbaar is met het bestelde product. In dat geval heeft de Consument het recht om de Overeenkomst zonder kosten te beëindigen en het product kosteloos te retourneren.

Artikel 7. Abonnementsbeleid

7.1 We bieden de mogelijkheid om je te abonneren op ons complete online programma via de Dick Staal Online Training School. Bij het abonneren op een abonnement kiest de klant voor een periode van één maand, kwartaal of jaar. Alle abonnementen zijn doorlopend en stoppen alleen als ze worden geannuleerd.

7.2 Annulering kan via e-mail naar info@dogtrainingdickstaal.com en wordt bevestigd via e-mail. Als een abonnement niet wordt geannuleerd, wordt het automatisch verlengd op maandelijkse, driemaandelijkse of jaarlijkse basis, afhankelijk van het abonnementstype dat de klant heeft gekozen.

7.3 De eerste betaling wordt gedaan met de door de klant gekozen betaalmethode, en de klant stemt in met onze algemene voorwaarden en machtigt ons om de volgende abonnementsbetalingen af te schrijven. Deze worden afgeschreven op maandelijkse, driemaandelijkse of jaarlijkse basis, afhankelijk van het abonnementstype dat de klant heeft gekozen.

7.4 Als de klant opzegt voordat de volgende betalingstermijn wordt bereikt, worden er geen verdere kosten in rekening gebracht.

7.5 Het is niet toegestaan om betalingen terug te vorderen, omdat dit in strijd is met de voorwaarden van deze overeenkomst, en het abonnement zal opnieuw worden afgeschreven.

Artikel 8. Retourbeleid voor online diensten en online cursussen

8.1 Abonnementen op online diensten en online cursussen kunnen niet worden geretourneerd. We bieden echter een "niet-goed-geld-terug-garantie" van 14 dagen. De klant komt in aanmerking voor een terugbetaling als de inhoud aanzienlijk afwijkt van hun verwachtingen of als het account niet werkt.

8.2 De klant komt niet in aanmerking als ze al meer dan 25% van een bepaalde cursus met het account hebben bekeken, omdat ze in korte tijd een aanzienlijke hoeveelheid inhoud hebben bekeken kan er daarom vanuit gegaan worden dat de klant niet ontevreden is over de inhoud.

Artikel 9. Recht van ontbinding/retour

9.1. Dit artikel is alleen van toepassing als de Consument een natuurlijk persoon is die niet handelt in zijn of haar professionele of commerciële hoedanigheid. Zakelijke Consumenten hebben dus geen recht op ontbinding.

9.2. De Consument heeft het recht om de overeenkomst op afstand met Dog Training Dick Staal binnen 14 dagen na ontvangst van het product te ontbinden, kosteloos en zonder opgave van redenen. Dit geldt niet voor online cursussen, diensten en abonnementen zoals beschreven in artikel 7 en 8 van deze algemene voorwaarden.

9.3. De termijn gaat in op de dag nadat het product door de consument of een door de consument aangewezen derde partij, die niet de vervoerder is, is ontvangen, of:
als de levering van een product uit verschillende leveringen of onderdelen bestaat: de dag waarop de Consument, of een door de Consument aangewezen derde partij, de laatste levering of het laatste onderdeel heeft ontvangen;

bij contracten voor de regelmatige levering van producten gedurende een bepaalde periode: de dag waarop de Consument, of een door de Consument aangewezen derde partij, het laatste product heeft ontvangen;
als de Consument meerdere producten heeft besteld: de dag waarop de Consument, of een door de Consument aangewezen derde partij, het laatste product heeft ontvangen.

9.4. Alleen de directe kosten voor de retourzending zijn voor rekening van de Consument. Dit betekent dat de Consument de kosten van het retourneren van het product moet betalen. Eventuele verzendkosten die door de Consument zijn betaald en de aankoopprijs van het product worden aan de Consument terugbetaald als de gehele bestelling wordt geretourneerd.

9.5. De Consument zal zorgvuldig omgaan met het product en de verpakking. De Consument mag de verpakking niet openen of het product gebruiken, tenzij dit nodig is om de aard, kenmerken en werking van de producten te bepalen.

9.6. De Consument is alleen aansprakelijk voor de waardevermindering van het product als gevolg van het anders behandelen van het product dan is toegestaan.

9.7. De Consument kan de Overeenkomst beëindigen door binnen de herroepingstermijn de herroeping (digitaal of op een andere vorm) aan Dog Training Dick Staal te melden, met behulp van het modelformulier voor herroeping of op een andere eenduidige manier. Als Dog Training Dick Staal de mogelijkheid biedt om de herroeping via elektronische/digitale middelen kenbaar te maken, dan stuurt Dog Training Dick Staal na ontvangst van een dergelijke verklaring onmiddellijk een bevestiging van ontvangst.

9.8. Zo snel mogelijk, maar uiterlijk binnen 14 dagen na de dag van melding, dient de Consument het product te retourneren of over te dragen aan (een vertegenwoordiger van) Dog Training Dick Staal. De Consument kan het product direct naar Dog Training Dick Staal sturen zonder voorafgaande kennisgeving van herroeping binnen de periode van 14 dagen. In dit geval moet de Consument een schriftelijke kennisgeving van herroeping toevoegen, zoals het modelformulier. Producten kunnen worden geretourneerd naar het volgende adres:

9.9. Eventuele reeds door de Consument (vooruit) betaalde bedragen worden zo snel mogelijk, maar in ieder geval binnen 14 dagen na ontbinding van de Overeenkomst, aan de Consument terugbetaald. Als de Consument een duurdere verzendmethode heeft gekozen in plaats van de goedkoopste standaardlevering, hoeft Dog Training Dick Staal de extra kosten van de duurdere methode niet terug te betalen. Behalve in gevallen waarin Dog Training Dick Staal heeft aangeboden het product zelf op te halen, kan hij de terugbetaling uitstellen totdat hij het product heeft ontvangen of totdat de Consument kan aantonen dat hij het product heeft geretourneerd, afhankelijk van welk moment eerder is.

9.10. Informatie over de toepasselijkheid of niet-toepasselijkheid van een herroepingsrecht en de eventuele vereiste procedure wordt duidelijk op de Website vermeld, ruim voordat de Overeenkomst wordt gesloten.

9.11. Het herroepingsrecht is niet van toepassing op:
De levering van digitale inhoud anders dan op een materiële drager, maar alleen als de levering is begonnen met de uitdrukkelijke voorafgaande instemming van de Consument, en de Consument heeft verklaard dat dit betekent dat hij zijn herroepingsrecht verliest;

Artikel 10. Betaling

10.1. De klant dient de verschuldigde bedragen aan Dog Training Dick Staal te betalen volgens de bestelprocedure en de betaalmethoden die op de website zijn aangegeven. Dog Training Dick Staal is vrij om elke betaalmethode van haar keuze aan te bieden en kan deze methoden op elk moment wijzigen. In geval van betaling na levering krijgt de klant een betalingstermijn van 14 dagen die ingaat op de dag na levering.

Artikel 11. Garantie en conformiteit

11.1. Dit artikel is alleen van toepassing indien de consument een natuurlijke persoon is die niet handelt in zijn of haar professionele of commerciële hoedanigheid. Als Dog Training Dick Staal een aparte garantie op de producten geeft, dan geldt dit zonder afbreuk te doen aan het voorgaande voor alle soorten consumenten.

11.2. Dog Training Dick Staal garandeert dat de producten in overeenstemming zijn met de overeenkomst, de specificaties vermeld in het aanbod, de redelijke eisen van betrouwbaarheid en/of bruikbaarheid en met de bestaande wettelijke voorschriften en/of overheidsregels die van kracht zijn vanaf de datum van het aangaan van de overeenkomst. Indien uitdrukkelijk overeengekomen, garandeert Dog Training Dick Staal ook dat het product geschikt is voor ander dan normaal gebruik.

11.3. Als het geleverde product niet in overeenstemming is met de overeenkomst, dient de consument Dog Training Dick Staal binnen een redelijke termijn na ontdekking van het gebrek hiervan op de hoogte te stellen.

11.4. Indien Dog Training Dick Staal de klacht gegrond acht, worden de defecte producten in overleg met de consument gerepareerd, vervangen of vergoed. Het maximale bedrag aan compensatie is, met inachtneming van het artikel over aansprakelijkheid, gelijk aan de prijs die de consument voor het product heeft betaald.

Artikel 12. Garantie bij zakelijke aankopen

12.1. Dog Training Dick Staal garandeert dat de producten in overeenstemming zijn met de overeenkomst, de specificaties vermeld in het aanbod, de redelijke eisen van betrouwbaarheid en/of bruikbaarheid en met de bestaande wettelijke voorschriften en/of overheidsregels die van kracht zijn vanaf de datum van het aangaan van de overeenkomst. Indien uitdrukkelijk overeengekomen, garandeert Dog Training Dick Staal ook dat het product geschikt is voor ander dan normaal gebruik. Anders geldt dat het product geschikt is voor normaal gebruik.

12.2. Als het geleverde product niet in overeenstemming is met de overeenkomst, dient de klant Dog Training Dick Staal binnen een redelijke termijn na ontdekking van het gebrek hiervan op de hoogte te stellen.
12.3. Indien Dog Training Dick Staal de klacht gegrond acht, worden de defecte producten in overleg met de klant gerepareerd, vervangen of (gedeeltelijk) vergoed. De maximale vergoeding is gelijk aan de prijs die de klant heeft betaald voor het product, met inachtneming van het artikel over aansprakelijkheid.

Artikel 13. Klachtenafhandelingsprocedure

13.1. Als de klant klachten heeft met betrekking tot een product (overeenkomstig het artikel over garanties en conformiteit) en/of over andere aspecten van de service van Dog Training Dick Staal, kan hij/zij een klacht indienen per telefoon, e-mail of per post. Zie de contactgegevens onderaan de Algemene Voorwaarden.

13.2. Dog Training Dick Staal zal zo snel mogelijk, en in ieder geval binnen 1 dag na ontvangst van de klacht, reageren. Als het voor Dog Training Dick Staal nog niet mogelijk is om een inhoudelijke reactie te geven op de klacht binnen die tijd, zal Dog Training Dick Staal binnen 1 dag na ontvangst van de klacht bevestigen dat de klacht is ontvangen en een indicatie geven van de termijn waarbinnen Dog Training Dick Staal verwacht een inhoudelijke of definitieve reactie op de klacht te kunnen geven.

13.3. Als de klant een natuurlijke persoon is die niet handelt in zijn of haar professionele of commerciële hoedanigheid, kan hij/zij een klacht indienen via het Europese online geschillenbeslechtingsplatform dat beschikbaar is op: http://ec.europa.eu/odr/.

Artikel 14. Aansprakelijkheid

14.1. Dit artikel is alleen van toepassing indien de consument een natuurlijke persoon of een rechtspersoon is die handelt in zijn professionele of commerciële hoedanigheid.

14.2. De totale aansprakelijkheid van Dog Training Dick Staal ten opzichte van de consument als gevolg van een toerekenbare tekortkoming in de nakoming van de overeenkomst is beperkt tot een vergoeding die niet hoger is dan de prijs die is vastgesteld voor die specifieke overeenkomst (inclusief btw).

14.3. De aansprakelijkheid van Dog Training Dick Staal ten opzichte van de consument voor indirecte schade of verlies, waaronder in elk geval – maar expliciet niet beperkt tot – gevolgschade, gederfde winst, bespaarde kosten, verlies van gegevens en schade als gevolg van bedrijfsstilstand, is uitgesloten.

14.4. Afgezien van de gevallen genoemd in de twee voorgaande leden van dit artikel, is Dog Training Dick Staal in geen geval aansprakelijk jegens de consument voor schade, ongeacht de grond waarop de vordering tot schadevergoeding is gebaseerd. Deze beperkingen in dit artikel zijn echter niet van toepassing indien de schade of het verlies het gevolg is van opzet of grove nalatigheid aan de zijde van Dog Training Dick Staal.

14.5. Dog Training Dick Staal is alleen aansprakelijk jegens de consument in geval van een toerekenbare tekortkoming in de nakoming van de overeenkomst, indien de consument zonder vertraging een juiste ingebrekestelling aan Dog Training Dick Staal verstrekt, waarin een redelijke termijn wordt gesteld om de tekortkoming te herstellen, en Dog Training Dick Staal ook na het verstrijken van die termijn in gebreke blijft. De ingebrekestelling moet een zo gedetailleerd mogelijke beschrijving van de tekortkoming bevatten, zodat Dog Training Dick Staal een adequaat antwoord kan geven.

14.6. Elk recht op schadevergoeding is altijd afhankelijk van de voorwaarde dat de consument de schade of het verlies schriftelijk meldt aan Dog Training Dick Staal zo snel mogelijk, maar uiterlijk binnen 30 dagen nadat de schade of het verlies zich heeft voorgedaan.

14.7. In geval van overmacht is Dog Training Dick Staal niet aansprakelijk voor enige schade of verlies die de consument heeft geleden als gevolg daarvan.

Artikel 15. Persoonlijke gegevens

15.1. Dog Training Dick Staal zal de persoonlijke gegevens van de consument verwerken in overeenstemming met het privacy beleid dat te vinden is op https://community.dogtrainingdickstaal.com/about/policies/privacy-policy.

Artikel 16. Slotbepalingen

16.1. Deze overeenkomst valt onder de wetten van het land waar de webshop is gevestigd.

16.2. Voor zover niet anders voorgeschreven door dwingend recht, worden alle geschillen voortvloeiend uit de overeenkomst voorgelegd aan de bevoegde Nederlandse rechter in het arrondissement waar Dog Training Dick Staal is gevestigd.

16.3. Indien een bepaling van deze Algemene Voorwaarden nietig blijkt te zijn, tast dit niet de geldigheid van de Algemene Voorwaarden als geheel aan. In dat geval zullen de partijen een of meer nieuwe bepalingen opstellen ter vervanging van de nietige bepaling, die zo veel mogelijk aansluit bij de oorspronkelijke bepaling en de bedoeling ervan.

16.4. Het begrip "schriftelijk" in deze Algemene Voorwaarden omvat ook communicatie per e- mail en fax, mits de identiteit van de afzender en de integriteit van het e-mailbericht voldoende zijn vastgesteld.
